What Is Reasonable Suspicion Drug Testing?

Reasonable suspicion drug testing is when an employer tests an employee because a trained supervisor has directly observed signs of drug or alcohol impairment at work. It's not based on a rumor or a hunch — it requires documented, specific observations made in person.

This type of testing applies to both DOT-covered and non-DOT employees, but the rules are different for each.

What Signs Justify a Reasonable Suspicion Test?

Supervisors should document observable signs, which may include:

Appearance

  • Bloodshot or watery eyes
  • Slurred speech
  • Unusual smell (alcohol, marijuana)
  • Unsteady walking or coordination problems

Behavior

  • Erratic or unusual conduct
  • Inability to focus or follow instructions
  • Extreme mood swings or aggression
  • Falling asleep on the job

Performance

  • Sudden drop in work quality
  • Near-miss accidents or safety violations
  • Failure to complete tasks they normally handle

DOT Reasonable Suspicion Rules

For DOT-covered employees (like CDL drivers), the rules are strict:

  • At least one trained supervisor must personally observe the signs
  • The supervisor must have completed DOT-required reasonable suspicion training
  • Observations must be documented before the test is ordered
  • The employee must be removed from safety-sensitive duty immediately
  • Alcohol testing should happen within 2 hours of the supervisor's observation

Non-DOT Reasonable Suspicion Rules

For non-DOT employees, your company policy sets the rules. Common requirements include:

  • One or two supervisors must observe and document the behavior
  • A supervisor should not conduct the test alone — HR or a second witness is recommended
  • The test must be authorized by the appropriate person in your organization
  • Documentation should be retained in the employee's file
